Terms of Service

1. Acceptance of Terms
By accessing or using SwiftPrism (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract in your jurisdiction.
2. Description of Service
SwiftPrism provides financial news, market data feeds, portfolio tools, and automated intelligence features (including SwiftPrism Intel and SwiftPrism Chat) to help users understand markets in plain language.
The Service may include AI-generated summaries, Deep Insights, watches, alerts, and translations. Outputs are produced automatically from third-party sources and models; they may be incomplete, delayed, or incorrect.
3. Not Financial Advice
SwiftPrism provides information and educational-style analysis only. Nothing on the Service is financial, investment, tax, or legal advice, and we are not a registered financial adviser or broker.
Past performance is not indicative of future results. You are solely responsible for your trading and investment decisions. Always do your own research and consult qualified professionals where appropriate.
4. User Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account.
Notify us promptly at support@swiftprism.app if you suspect unauthorized access.
5. Subscriptions and Payments
Free tier is provided as-is with usage limits described on the membership page.
Paid plans (Premium and Elite) are billed monthly through Stripe unless otherwise stated at checkout. Subscriptions renew automatically until cancelled.
You may cancel anytime via your account billing settings (Stripe Customer Portal). Cancellation stops future charges; access typically continues until the end of the current billing period.
Refunds are handled case-by-case in line with applicable consumer law. Contact support@swiftprism.app within 14 days of a charge if you believe a refund is warranted.
We may change pricing with reasonable notice. Price changes apply to subsequent billing periods.
6. Acceptable Use
You agree not to:
- Scrape, resell, or redistribute SwiftPrism content, feeds, or insights without written permission
- Reverse-engineer, probe, or overload the Service
- Use the Service for unlawful purposes or to harass others
- Share account access or circumvent tier limits
- Misrepresent AI-generated outputs as guaranteed or personalized professional advice
7. Intellectual Property
SwiftPrism, its branding, software, and original content are owned by us or our licensors. You receive a limited, personal, non-transferable licence to use the Service for your own purposes.
Market data, headlines, and third-party content remain the property of their respective providers and are subject to their terms.
8. Third-Party Services and Data
The Service relies on third parties (e.g. market data providers, hosting, payments, authentication, and AI models). We do not control and are not responsible for third-party services or the accuracy of their data.
Outages, rate limits, or changes at third-party providers may affect availability or timeliness of features.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted access, error-free operation, or that insights will be accurate, complete, or timely.
10. Limitation of Liability
To the maximum extent permitted by law, SwiftPrism and its owners, directors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or trading losses arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of (a) amounts you paid us in the 12 months before the claim, or (b) NZD $100, except where liability cannot be excluded by law.
11. Indemnity
You agree to indemnify and hold harmless SwiftPrism from claims arising from your misuse of the Service, violation of these terms, or infringement of third-party rights.
12. Termination
We may suspend or terminate access for breach of these terms, abuse, non-payment, or legal requirement. You may stop using the Service at any time and cancel paid subscriptions as described above.
Sections that by nature should survive (disclaimers, liability limits, governing law) survive termination.
13. Governing Law
These terms are governed by the laws of New Zealand. You agree to the exclusive jurisdiction of the courts of New Zealand, subject to any mandatory consumer protections in your country of residence.
14. Changes to Terms
We may update these terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance, except where applicable law requires additional consent.
